 The Vatican - May 16, 2009A clarification from the Congregation for the Doctrine of the Faith (CDF) appeared in L’Osservatore Romano‘s July 11th Italian edition reaffirming the Church’s defense of the protection of human life, and its stand against abortion.  This clarification is being widely reported to be the result of an order issued by Benedict XVI to Tarcisio Cardinal Bertone, after L’Osservatore Romano  published an article written by the new head of the Pontifical Academy for Life, Archbishop Salvatore Fisichella, which outraged Catholics all over the world.   Archbishop Fisichella stated  that doctors who committed an abortion on the twins of a  9 year-old Brazilian rape victim were not deserving of excommunication.    The newspaper L’Osservatore Romano, which carried Archbishop Fisichella’s  article, operates under the supervision of the Secretariat of State, headed by Tarcisio Cardinal Bertone.

It has also been reported that 27 of the 46 members of the Pontifical Academy for Life wrote to Archbishop Fisichella requesting that he recant his “wrong” position.  Archbishop Fisichella rejected the request.  In frustration, the 27 members that signed the request turned to the Congregation for the Doctrine of the Faith for help, headed by Cardinal Levada– but were ignored.

Italian journalist and expert in Vatican affairs, Sandro Magister, reported that as a final measure the 27 signatories of the Pontifical Academy for Life submitted their petition to Benedict XVI, who is believed to have ordered Cardinal Bertone to issue a statement reaffirming and clarifying the Church’s doctrine on the sanctity of human life. 

To add insult to injury, only 27 members of the 46 that comprise the Pontifical Academy for Life signed the request objecting to Archbishop Fisichella’s shameful statements.  And the other 19?  Have they joined the ranks of L’Osservatore Romano’s editor, who refers to abortion as a “delicate matter.”   What about Archbishop Fisichella’s article , published on March 15  in L’Osservatore Romano– was it written under the supervision of Cardinal Bertone?

The English version of the clarification statement from the CDF is provided below.   One has to assume that the “manipulation and exploitation” mentioned in the first paragraph of the clarification, refers to the indignation and outrage expressed by Catholics who defend the sanctity of life– since there is no condemnation of Archbishop Fisichella’s actions.

The Vatican has found it necessary to  issue statements clarifying and reaffirming the sanctity of human life– not in an encyclical form, but as a reactionary and defensive measure, due to the shameful action of some members of the Curia. 

Certain socialists and progressives in Rome have been waiting to set their plans in motion.  Is Obama their great prophet? 

“Divide and conquer” is under way from within.

Here is the English version of the Clarification from the Congregation for the Doctrine of the Faith (CDF)– followed by the original text in Italian:

Recently a number of letters have been sent to the Holy See, some of them from prominent figures in political and ecclesial life, explaining the confusion that has been created in various countries, especially in Latin America, following the manipulation and exploitation of an article by His Excellency Archbishop Rino Fisichella, president of the Pontifical Academy for Life, on the sad affair of the “Brazilian girl.”

In this article, which appeared in “L’Osservatore Romano” on March 15, 2009, the doctrine of the Church was presented, while still keeping in mind the dramatic situation of the aforementioned girl, who – as could be demonstrated afterward – had been accompanied with all pastoral delicacy, in particular by the archbishop of Olinda and Recife at the time, His Excellency Archbishop José Cardoso Sobrinho.

In this regard, the Congregation for the Doctrine of the Faith reiterates that the Church’s teaching on procured abortion has not changed, nor can it change.

This teaching has been presented in numbers 2270-2273 in the Catechism of the Catholic Church, in these terms:

«Human life must be respected and protected absolutely from the moment of conception. From the first moment of his existence, a human being must be recognized as having the rights of a person – among which is the inviolable right of every innocent being to life “Before I formed you in the womb I knew you, and before you were born I consecrated you” (Jer. 1:5). “My frame was not hidden from you, when I was being made in secret, intricately wrought in the depths of the earth” (Psalm 139:15).

«Since the first century the Church has affirmed the moral evil of every procured abortion.
This teaching has not changed and remains unchangeable. Direct abortion, that is to say, abortion willed either as an end or a means, is gravely contrary to the moral law: “You shall not kill the embryo by abortion and shall not cause the newborn to perish” (Didaché, 2:2). “God, the Lord of life, has entrusted to men the noble mission of safeguarding life, and men must carry it out in a manner worthy of themselves. Life must be protected with the utmost care from the moment of conception: abortion and infanticide are abominable crimes” (Vatican Council II, “Gaudium et Spes”, 51).

«Formal cooperation in an abortion constitutes a grave offense. The Church attaches the canonical penalty of excommunication to this crime against human life. “A person who procures a completed abortion incurs excommunication latae sententiae,” (Code of Canon Law, can. 1398), “by the very commission of the offense” (Code of Canon Law, can. 1314) and subject to the conditions provided by Canon Law (cf. Code of Canon Law, can. 1323-1324). The Church does not thereby intend to restrict the scope of mercy. Rather, she makes clear the gravity of the crime committed, the irreparable harm done to the innocent who is put to death, as well as to the parents and the whole of society.

«The inalienable right to life of every innocent human individual is a constitutive element of a civil society and its legislation: “The inalienable rights of the person must be recognized and respected by civil society and the political authority. These human rights depend neither on single individuals nor on parents; nor do they represent a concession made by society and the state; they belong to human nature and are inherent in the person by virtue of the creative act from which the person took his origin. Among such fundamental rights one should mention in this regard every human being’s right to life and physical integrity from the moment of conception until death… The moment a positive law deprives a category of human beings of the protection which civil legislation ought to accord them, the state is denying the equality of all before the law. When the state does not place its power at the service of the rights of each citizen, and in particular of the more vulnerable, the very foundations of a state based on law are undermined… As a consequence of the respect and protection which must be ensured for the unborn child from the moment of conception, the law must provide appropriate penal sanctions for every deliberate violation of the child’s rights.” (Congregation for the Doctrine of the Faith, Instruction “Donum Vitae”, III)».

In the encyclical “Evangelium Vitae,” Pope John Paul II reaffirmed this teaching with his authority as Supreme Pastor of the Church:

«By the authority which Christ conferred upon Peter and his Successors, in communion with the Bishops-who on various occasions have condemned abortion and who in the aforementioned consultation, albeit dispersed throughout the world, have shown unanimous agreement concerning this doctrine-I declare that direct abortion, that is, abortion willed as an end or as a means, always constitutes a grave moral disorder, since it is the deliberate killing of an innocent human being. This doctrine is based upon the natural law and upon the written Word of God, is transmitted by the Church’s Tradition and taught by the ordinary and universal Magisterium. No circumstance, no purpose, no law whatsoever can ever make licit an act which is intrinsically illicit, since it is contrary to the Law of God which is written in every human heart, knowable by reason itself, and proclaimed by the Church» (no. 62).

As for abortion procured in certain difficult and complex situations, the clear and precise teaching of Pope John Paul II applies:

«It is true that the decision to have an abortion is often tragic and painful for the mother, insofar as the decision to rid herself of the fruit of conception is not made for purely selfish reasons or out of convenience, but out of a desire to protect certain important values such as her own health or a decent standard of living for the other members of the family. Sometimes it is feared that the child to be born would live in such conditions that it would be better if the birth did not take place. Nevertheless, these reasons and others like them, however serious and tragic, can never justify the deliberate killing of an innocent human being» (Encyclical “Evangelium Vitae”, no. 58).

As for the problem of specific medical treatments intended to preserve the health of the mother, it is necessary to make a strong distinction between two different situations: on the one hand, a procedure that directly causes the death of the fetus, sometimes inappropriately called “therapeutic” abortion, which can never be licit in that it is the direct killing of an innocent human being; on the other hand, a procedure not abortive in itself that can have, as a collateral consequence, the death of the child:

«If, for example, saving the life of the future mother, independently of her condition of pregnancy, urgently required a surgical procedure or another therapeutic application, which would have as an accessory consequence, in no way desired or intended, but inevitable, the death of the fetus, such an action could not be called a direct attack on the innocent life. In these conditions, the operation can be considered licit, as can other similar medical procedures, always provided that a good of high value, like life, is at stake, and that it is not possible to postpone it until after the birth of the child, or to use any other effective remedy» (Pius XII, Speech to the Fronte della Famiglia and the Associazione Famiglie numerose, November 27, 1951).

As for the responsibility of medical workers, the words of Pope John Paul II must be recalled:

«Their profession calls for them to be guardians and servants of human life. In today’s cultural and social context, in which science and the practice of medicine risk losing sight of their inherent ethical dimension, health-care professionals can be strongly tempted at times to become manipulators of life, or even agents of death. In the face of this temptation their responsibility today is greatly increased. Its deepest inspiration and strongest support lie in the intrinsic and undeniable ethical dimension of the health-care profession, something already recognized by the ancient and still relevant Hippocratic Oath, which requires every doctor to commit himself to absolute respect for human life and its sacredness» (Encyclical “Evangelium Vitae”, no. 89).

 Sull’aborto procurato

Recentemente sono pervenute alla Santa Sede diverse lettere, anche da parte di alte personalità della vita politica ed ecclesiale, che hanno informato sulla confusione creatasi in vari Paesi, soprattutto in America Latina, a seguito della manipolazione e strumentalizzazione di un articolo di Sua Eccellenza Monsignor Rino Fisichella, Presidente della Pontificia Accademia per la Vita, sulla triste vicenda della “bambina brasiliana”.
In tale articolo, apparso su “L’Osservatore Romano” del 15 marzo 2009, si proponeva la dottrina della Chiesa, pur tenendo conto della situazione drammatica della suddetta bambina, che – come si poteva rilevare successivamente – era stata accompagnata con ogni delicatezza pastorale, in particolare dall’allora Arcivescovo di Olinda e Recife, Sua Eccellenza Monsignor José Cardoso Sobrinho. Al riguardo, la Congregazione per la Dottrina della Fede ribadisce che la dottrina della Chiesa sull’aborto provocato non è cambiata né può cambiare.
Tale dottrina è stata esposta nei numeri 2270-2273 del Catechismo della Chiesa Cattolica in questi termini:   “La vita umana deve essere rispettata e protetta in modo assoluto fin dal momento del concepimento. Dal primo istante della sua esistenza, l’essere umano deve vedersi riconosciuti i diritti della persona, tra i quali il diritto inviolabile di ogni essere innocente alla vita. “Prima di formarti nel grembo materno, ti conoscevo, prima che tu uscissi alla luce, ti avevo consacrato” (Ger 1, 5). “Non ti erano nascoste le mie ossa quando venivo formato nel segreto, intessuto nelle profondità della terra” (Sal 139, 15).
“Fin dal primo secolo la Chiesa ha dichiarato la malizia morale di ogni aborto provocato. Questo insegnamento non è mutato. Rimane invariabile. L’aborto diretto, cioè voluto come un fine o come un mezzo, è gravemente contrario alla legge morale: “Non uccidere il bimbo con l’aborto, e non sopprimerlo dopo la nascita” (Didaché, 2, 2). “Dio, padrone della vita, ha affidato agli uomini l’altissima missione di proteggere la vita, missione che deve essere adempiuta in modo degno dell’uomo. Perciò la vita, una volta concepita, deve essere protetta con la massima cura; e l’aborto come pure l’infanticidio sono abominevoli delitti” (Concilio Vaticano II, Gaudium et spes, 51).
“La cooperazione formale a un aborto costituisce una colpa grave. La Chiesa sanziona con una pena canonica di scomunica questo delitto contro la vita umana. “Chi procura l’aborto, se ne consegue l’effetto, incorre nella scomunica latae sententiae” (Cic, can. 1398), “per il fatto stesso d’aver commesso il delitto” (Cic, can. 1314) e alle condizioni previste dal diritto (cfr. Cic, cann. 1323-1324). La Chiesa non intende in tal modo restringere il campo della misericordia. Essa mette in evidenza la gravità del crimine commesso, il danno irreparabile causato all’innocente ucciso, ai suoi genitori e a tutta la società.
“Il diritto inalienabile alla vita di ogni individuo umano innocente rappresenta un elemento costitutivo della società civile e della sua legislazione: “I diritti inalienabili della persona dovranno essere riconosciuti e rispettati da parte della società civile e dell’autorità politica; tali diritti dell’uomo non dipendono né dai singoli individui, né dai genitori e neppure rappresentano una concessione della società e dello Stato: appartengono alla natura umana e sono inerenti alla persona in forza dell’atto creativo da cui ha preso origine. Tra questi diritti fondamentali bisogna, a questo proposito, ricordare: il diritto alla vita e all’integrità fisica di ogni essere umano dal concepimento alla morte… Nel momento in cui una legge positiva priva una categoria di esseri umani della protezione che la legislazione civile deve loro accordare, lo Stato viene a negare l’uguaglianza di tutti davanti alla legge. Quando lo Stato non pone la sua forza al servizio dei diritti di ciascun cittadino, e in particolare di chi è più debole, vengono minati i fondamenti stessi di uno Stato di diritto…
Come conseguenza del rispetto e della protezione che vanno accordati al nascituro, a partire dal momento del suo concepimento, la legge dovrà prevedere appropriate sanzioni penali per ogni deliberata violazione dei suoi diritti” (Congregazione per la Dottrina della Fede, Istruzione Donum vitae, III)”.
Nell’Enciclica Evangelium Vitae Papa Giovanni Paolo II ha riaffermato tale dottrina con la sua autorità di Supremo Pastore della Chiesa: “Con l’autorità che Cristo ha conferito a Pietro e ai suoi Successori, in comunione con i Vescovi – che a varie riprese hanno condannato l’aborto e che nella consultazione precedentemente citata, pur dispersi per il mondo, hanno unanimemente consentito circa questa dottrina – dichiaro che l’aborto diretto, cioè voluto come fine o come mezzo, costituisce sempre un disordine morale grave, in quanto uccisione deliberata di un essere umano innocente. Tale dottrina è fondata sulla legge naturale e sulla Parola di Dio scritta, è trasmessa dalla Tradizione della Chiesa ed insegnata dal Magistero ordinario e universale” (n. 62).
Per quanto riguarda l’aborto procurato in alcune situazioni difficili e complesse, vale l’insegnamento chiaro e preciso di Papa Giovanni Paolo II: “È vero che molte volte la scelta abortiva riveste per la madre carattere drammatico e doloroso, in quanto la decisione di disfarsi del frutto del concepimento non viene presa per ragioni puramente egoistiche e di comodo, ma perché si vorrebbero salvaguardare alcuni importanti beni, quali la propria salute o un livello dignitoso di vita per gli altri membri della famiglia. Talvolta si temono per il nascituro condizioni di esistenza tali da far pensare che per lui sarebbe meglio non nascere. Tuttavia, queste e altre simili ragioni, per quanto gravi e drammatiche, non possono mai giustificare la soppressione deliberata di un essere umano innocente” (Enciclica Evangelium vitae, n. 58).
Quanto alla problematica di determinati trattamenti medici al fine di preservare la salute della madre occorre distinguere bene tra due fattispecie diverse: da una parte un intervento che direttamente provoca la morte del feto, chiamato talvolta in modo inappropriato aborto “terapeutico”, che non può mai essere lecito in quanto è l’uccisione diretta di un essere umano innocente; dall’altra parte un intervento in sé non abortivo che può avere, come conseguenza collaterale, la morte del figlio: “Se, per esempio, la salvezza della vita della futura madre, indipendentemente dal suo stato di gravidanza, richiedesse urgentemente un atto chirurgico, o altra applicazione terapeutica, che avrebbe come conseguenza accessoria, in nessun modo voluta né intesa, ma inevitabile, la morte del feto, un tale atto non potrebbe più dirsi un diretto attentato alla vita innocente. In queste condizioni l’operazione può essere considerata lecita, come altri simili interventi medici, sempre che si tratti di un bene di alto valore, qual è la vita, e non sia possibile di rimandarla dopo la nascita del bambino, né di ricorrere ad altro efficace rimedio” (Pio xii, Discorso al “Fronte della Famiglia” e all’Associazione Famiglie numerose, 27 novembre 1951).
Quanto alla responsabilità degli operatori sanitari, occorre ricordare le parole di Papa Giovanni Paolo II: “La loro professione li vuole custodi e servitori della vita umana. Nel contesto culturale e sociale odierno, nel quale la scienza e l’arte medica rischiano di smarrire la loro nativa dimensione etica, essi possono essere talvolta fortemente tentati di trasformarsi in artefici di manipolazione della vita o addirittura in operatori di morte. Di fronte a tale tentazione la loro responsabilità è oggi enormemente accresciuta e trova la sua ispirazione più profonda e il suo sostegno più forte proprio nell’intrinseca e imprescindibile dimensione etica della professione sanitaria, come già riconosceva l’antico e sempre attuale giuramento di Ippocrate, secondo il quale ad ogni medico è chiesto di impegnarsi per il rispetto assoluto della vita umana e della sua sacralità” (Enciclica Evangelium vitae, n. 89).
